Updates, Guidance, and Resources for the Chapter 33 Rule Governing Physical Restraint and Seclusion

Dear Champions of Education,

The following guidance is offered by the Maine Department of Education (DOE) relating to updates for the Rule Chapter 33 Governing Restraint and Seclusion in School. The Rule has been updated to align with Maine Statute 20-A MRS §4014<https://maine.us2.list-manage.com/track/click?u=a582edd6473e477ef6307c769&id=b348283555&e=4bb1694fe4> and became effective on June 16th, 2023. This notice includes guidance and resources related to the Rule.

The updated language for Chapter 33 <https://maine.us2.list-manage.com/track/click?u=a582edd6473e477ef6307c769&id=981b049c97&e=4bb1694fe4> sets forth permitted and unlawful uses of restraint and seclusion, required notification and documentation of incidents of restraint or seclusion, aggregate reporting of incidents to administrators and to the Maine DOE, notification to parents, response to multiple incidents of restraint or seclusion of a student, local and state complaint processes and Maine DOE approval of training programs.

The Office of School and Student Supports will be offering regularly scheduled Office Hours starting this month to answer any questions you have related to Chapter 33.   These office hours will occur at 11:00am on February 27, March 26, April 23, and May 28.
