PRIORITY NOTICE: Approval of Tydings Amendment Waiver of FY24 ESEA Funds and FY25 Carryover of Excess Title I, Part A Funds
Dear Champions of Education,
The ESEA Federal Programs Team is pleased to announce that we have been granted a Tydings Amendment Waiver of State Fiscal Year (FY) 2024 ESEA funds and State FY 2025 Carryover of Excess Title I, Part A Funds. Pursuant to the authority granted under Section 8401(b) of the Elementary and Secondary Education Act (ESEA), the Maine Department of Education (DOE) received approval for the following waivers from the U.S. Department of Education:
* A Tydings Amendment Waiver from Section 421(b) of the General Provisions Act, which serves to extend the period of availability of Federal FY 2023/State FY 2024 funding of the programs listed below until September 30, 2026. The programs affected by this waiver include:
* Title I, Part A of the ESEA (Improving Basic Programs Operated by Local Educational Agencies [LEAs])
* Title I, Part B of the ESEA (State Assessment Formula Grants)
* Title I, Part C of the ESEA (Education of Migratory Children)
* Title I, Part D, Subpart 1 of the ESEA (Prevention and Intervention Programs for Children and Youth Who Are Neglected, Delinquent, or At-Risk)
* Title II, Part A of the ESEA (Supporting Effective Instruction)
* Title III, Part A of the ESEA (English Language Acquisition, Language Enhancement, and Academic Achievement)
* Title IV, Part A of the ESEA (Student Support and Academic Enrichment Grants)
* Title IV, Part B of the ESEA (21st Century Community Learning Centers)
* Title V, Part B, Subpart 2 of the ESEA (Rural and Low-Income School Program)
* A waiver from Section 1127(a) of the ESEA for Federal FY 2024/State FY 2025 Title I, Part A funds (i.e., the Title I, Part A funds that will become carryover funds on October 1, 2025), which serves to waive the requirement that limits the Maine DOE’s ability to grant its LEAs with a waiver of the 15 percent Title I, Part A carryover limitation more than once in a three-year period.
