Is your CACFP up to date with current Federal non-discrimination requirements?
Discrimination is different treatment which makes a distinction of one person or a group of persons from others; either intentionally, by neglect, or by the actions or lack of actions based on a protected class.
For Federal Food and Nutrition Service programs, complaints are based on one or more of the six Federally protected bases: 1. Race 2. Color 3. National Origin 4. Age 5. Sex (including gender identity and sexual orientation) and 6. Disability. Maine State Law adds protections for persons with regard to 1. Religion 2. Ancestry and 3. Genetic Information
All Federal Child Nutrition Programs operating in the State of Maine must adopt both Federal and State protected classes.
As of 2022, the long Federal non-discrimination statement was updated. This policy update is consistent with the Supreme Court's decision in Bostock v. Clayton County, 140 S. Ct. 1731, 590 U.S. ___ (2020), and applies to prohibitions against discrimination based on sex in all FNS programs.
Please make sure that your program is compliant with current non-discrimination requirements:
* An updated "And Justice For All" poster will be released. For now, continue to use your current AJFA posters- we will let everyone know when the new posters are available. Remember to display the AJFA poster in a prominent location for all to view. If you need additional copies of the AJFA poster, please contact Paula Nadeau at paula.nadeau at maine.gov<mailto:paula.nadeau at maine.gov>
* The most updated version of the Federal non-discrimination statement, or MDOE Child Nutrition's link to the full statement, must be used on all hard copies of CACFP materials, IEFs, social media websites (i.e., Facebook), program web pages, public information, including program literature, etc. The current, updated long Federal non-discrimination statement, as well as the short Federal non-discrimination statement, can be found here: https://www.maine.gov/doe/schools/nutrition/nondiscrimination
* At a minimum, the non-discrimination statement, or a link to it must be included on the home page of the program information.
* The non-discrimination statement must be in a font size no smaller than font size used in the rest of the publication.
* You must get prior State Agency approval for use of the short version on any program materials, except for program menus.
* You must provide appropriate information in alternative formats for persons with disabilities and in the appropriate language(s) for Limited English Proficiency (LEP) persons. * You must train your staff on Civil Rights in Child Nutrition Programs as part of your annual CACFP In-House Training requirements.
