Jenn,
In response to your question, if the former retiree is not a consultant,
providing the same service to other districts, the retiree would be
classified as an employee.
That said, the Department of Labor has guidelines regarding the
classification of independent contract status. I would suggest
reviewing their revised independent contractor rule.
